General Terms and Conditions of Use & Sale

Definitions:

  • "Seller" or "Company": ECOMB2S, trading as "Jade&Charly.com"
  • "Buyer" or "Customer": Any individual or legal entity making a purchase from the Company.

Preamble: The Seller offers products for sale online to consumers, accessible via its website. Product and service descriptions and prices are available on said site.

Article 1 - Purpose: These General Terms and Conditions of Sale (GTC) govern online transactions concerning the sale of products or services by the Seller.

Article 2 - Acceptance of GTC: The Buyer accepts the GTC by checking a box when placing an order. These GTC are an integral part of the contract between the Buyer and the Seller.

Article 3 - Price: Prices are indicated in euros, excluding and including all taxes, excluding shipping costs. Any customs duties and local taxes are the responsibility of the Buyer.

Article 4 - Ordering process: Orders are placed online via the site, with an order confirmation sent to the Customer by email.

Article 5 - Product features: The features, prices, and terms of use of the products are available online. Offers are valid as long as they are visible on the site.

Article 6 - Product conformity: Products sold comply with standards in force in France. In the event of defects, the Seller undertakes to refund or exchange non-conforming products.

Article 7 - Retention of title: Ownership of the products remains with the Company until full payment is received.

Article 8 - Delivery: Products are delivered to the address indicated by the Customer within the timeframes specified at the time of ordering.

Article 9 - Product availability: In the event of prolonged unavailability, the Customer will be informed and may cancel their order.

Article 10 - Payment: Payment is due immediately upon ordering, by credit card or Paypal.

Article 11 - Right of withdrawal: The Buyer has 14 days to withdraw without giving any reason, starting from the receipt of the order.

Article 12 - Legal warranties: The Seller is bound by the warranties of conformity and those relating to hidden defects.

Article 13 - Complaints and mediation: Complaints should be sent by email to sav@1001-lampes-de-chevet.com. A mediator may be contacted in the event of a dispute.

Article 14 - Contract termination: The Buyer may cancel the order under certain conditions, particularly in the event of non-conformity or late delivery.

Article 15 - Intellectual property: All elements of the Seller's site are protected by intellectual property rights.

Article 16 - Force majeure: The Seller cannot be held liable in the event of force majeure affecting the performance of the contract.

Article 17 - Contract modification: Any modification to the contract must be agreed upon in writing between the parties.

Article 18 - Personal data protection: Personal data is processed in accordance with Regulation 2016/679 (GDPR). The Customer has the right to access, rectify, and erase their data.

Article 18b - Governing law: The GTC are subject to French law.

Article 19 - Consumer information: References to articles of the Civil Code and the Consumer Code relating to legal warranties.
